How to handle the contract with your Nanny ?

If you wish to recruit a nanny, several possibilities are available to you. You can choose to look for the nanny yourself according to your needs. If you don’t have enough time, and you want to entrust this mission to professionals, it will be
possible in this case to call upon a company of service to the person or a cabinet of recruitment.

These two terms designate two similar services. The human service company allows you to call upon the services of a nanny on a one-time basis, one or two hours per week. The recruitment firm (such as Morgan & Mallet International) offers a more upscale service. Indeed, the candidates presented to the clients are people who are destined to stay in the family on a long term basis and who have acquired a solid experience in a private home with verified references.

The proposed contracts are mainly open-ended contracts for a minimum of twenty-five hours per week. A recruitment agency guarantees the reliability of the profiles presented, indeed each candidate carries out 1 to 2 interviews with a consultant before the references of his previous professional experiences are checked in their turn.
In addition, a three-month replacement guarantee is put in place as soon as the candidate takes up the position if he or she does not correspond to the client’s needs or if the client is not satisfied with the quality of the work.

Moreover, fixed-term contracts cannot be renewed indefinitely and must be justified by valid reasons (replacement, adjustment to the arrival of a new baby…).  If the recruited candidate does not bring satisfaction to the client or if the client does not need the employee anymore, it will be possible to terminate the contract in different ways: if a fixed-term contract was concluded with the employee, the latter will perform his/her duties until the planned end of the contract and then leave the client’s home.

If the client wishes the employee to leave the company without delay, the employee will be obliged to pay the remaining amount of the salary until the date of the end of the contract. In case an open-ended contract has been concluded with the employee, it will be imperative to have a valid reason to dismiss the employee. The reasons can be for serious misconduct or the advanced age of the children that no longer requires the nanny.

It will always be recommended to prefer the gentle termination. This will allow the position to be terminated on good terms and the conditions are advantageous for both parties.
